Effective date: September 24, 2026
These Terms of Service ("Terms") are a legal agreement between you and PrideLab LLC ("PrideLab," "Finding Fourth," "we," "us," or "our") governing your use of findingfourth.com and the Finding Fourth services (collectively, the "Service"). Finding Fourth helps adult tennis players discover other players, create and join matches or drills, and communicate within participating communities.
By creating an account, checking the acceptance box, or using the Service, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Service.
1 Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using the Service, you represent that you meet these requirements. The Service is currently intended for users in the United States.
2 Accounts and Account Security
You must provide accurate, current information and keep it updated. You may maintain only accounts you are authorized to use. You are responsible for activity under your account and for protecting access credentials and verification codes. Notify us promptly at m.sullivan@pridelab.com if you suspect unauthorized access.
A Finding Fourth member number is an internal identifier and does not verify identity, skill level, club membership, background, safety, or trustworthiness. We may require mobile-number or email verification and may reject, suspend, or restrict an account when information appears false, duplicated, compromised, or abusive.
3 Player Profiles and Community Membership
You control the information you submit to your player profile, subject to required fields and our rules. You must not misrepresent your name, age, gender, tennis level, community or club affiliation, availability, photograph, or other material information.
Access to a Finding Fourth community does not itself establish membership in, endorsement by, or permission to use any country club, tennis club, court, facility, homeowners association, municipality, or other organization. A community or organization may apply separate eligibility, guest, fee, reservation, dress, conduct, and court-access rules. You are responsible for confirming and following them.
We may require evidence of community or club eligibility, or allow a community administrator to approve, reject, or remove a membership. Community roles and ratings may differ between communities.
4 Matches Drills and Player Arrangements
Users may create or join tennis matches, drills, and related activities. The creator is responsible for entering accurate information, including format, number of players, date, time, location, level, fees, and participation status. Participants are responsible for confirming details directly and arriving prepared.
Finding Fourth provides communication and coordination tools. Unless we expressly state otherwise, PrideLab is not the organizer, host, coach, instructor, facility operator, payment processor, referee, or contracting party for a user-created match or drill. We do not guarantee that a match will occur, that a player will attend, that a court will be available, or that descriptions, levels, costs, and availability are accurate.
Any court, instructor, cover-up, guest, equipment, reservation, or other fee shown in the Service is informational unless PrideLab expressly collects it. Users are responsible for agreeing on payment, cancellation, reimbursement, and attendance arrangements. PrideLab is not responsible for a private payment dispute between users.
5 Assumption of Risk and Personal Safety
Tennis, drills, travel to facilities, and in-person meetings involve inherent and other risks, including falls, collisions, equipment injuries, heat or weather exposure, medical events, property damage, communicable illness, and misconduct by another person. You voluntarily assume the risks of participating in activities arranged through the Service to the fullest extent permitted by law.
You are responsible for determining whether an activity is appropriate for your health, ability, and circumstances; using suitable equipment; following facility rules; and obtaining professional medical advice when appropriate. Stop playing and seek assistance if conditions are unsafe.
Use reasonable precautions when meeting another user. Tell someone where you are going, meet at an appropriate public or staffed facility, protect personal contact information, and report suspicious conduct. In an emergency, contact 911 or local authorities. Finding Fourth is not an emergency service.
6 No Background Checks or Professional Verification
Unless expressly disclosed for a specific feature, PrideLab does not conduct criminal background checks, identity investigations, medical screening, credential verification, or independent verification of tennis ratings, club membership, coaching qualifications, or user statements. Verification of a telephone number or email address confirms control of that contact method, not the user's identity or character.
You are solely responsible for evaluating other users and deciding whether to communicate, meet, play, invite a guest, share information, or enter any arrangement.
7 Messages Notifications and SMS
The Service may allow direct messages and may send account, security, match, invitation, reminder, unread-message, service, or promotional communications. Message delivery is not guaranteed and may be delayed or blocked by a carrier, email provider, device, network, or user setting.
If you separately opt in to recurring SMS messages, message frequency varies and message and data rates may apply. Reply STOP to cancel applicable recurring SMS messages and HELP for help. Consent to promotional SMS is not a condition of using the Service. Informational and marketing consent will be collected separately when required. You remain responsible for keeping your telephone number current and for charges imposed by your carrier.
Users may not use the Service to send unsolicited promotions, repeated unwanted messages, harassment, threats, or unlawful communications. Do not add another person's telephone number unless you are authorized to provide it for the stated invitation or coordination purpose.
8 User Content
User Content means profile information, photographs, match listings, messages, reports, feedback, and other material you submit through the Service. You retain ownership of your User Content. You grant PrideLab a nonexclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, and otherwise use User Content only as reasonably necessary to operate, secure, moderate, and improve the Service, subject to our Privacy Policy and your available settings. This license does not permit PrideLab to use your profile photograph in external advertising without your separate affirmative consent. The license ends when the content is deleted from active systems, except for reasonable backup, legal, safety, and evidentiary retention.
You represent that you own or have the necessary rights and permissions for User Content and that our permitted use will not violate another person's rights. Do not upload another person's image or private information without authorization.
We may review, restrict, remove, preserve, or disclose User Content when reasonably necessary to operate the Service, investigate a report, enforce these Terms, protect safety or rights, or comply with law. We are not obligated to monitor all content and do not endorse User Content.
9 Prohibited Conduct
You may not:
use the Service for unlawful, fraudulent, deceptive, exploitative, or commercial-spam activity;
harass, threaten, stalk, discriminate against, impersonate, or deliberately endanger another person;
post nudity, sexually explicit content, nonconsensual intimate imagery, content sexualizing minors, or other exploitative material;
post hateful, violent, defamatory, privacy-invasive, infringing, or materially misleading content;
scrape, harvest, sell, rent, or compile user profiles, contact information, messages, photographs, or match data without authorization;
send another user's information to advertisers, lead generators, data brokers, or unrelated third parties;
circumvent access controls, probe security, introduce malware, interfere with the Service, automate unauthorized access, or reverse engineer protected portions of the Service;
create false, duplicate, or unauthorized accounts or evade a suspension;
use the Service to operate an unauthorized business, collect fees deceptively, or misrepresent affiliation with PrideLab, Finding Fourth, a club, or a community; or
encourage, assist, or attempt any prohibited conduct.
10 Reporting Blocking and Moderation
You may report a profile, message, photograph, match, or safety concern through available tools or by emailing m.sullivan@pridelab.com. We may investigate, request information, remove content, restrict communication, suspend accounts, notify a community administrator, preserve evidence, or contact authorities. We do not promise a particular result or response time except where law requires one.
Requests concerning nonconsensual intimate images should be clearly identified as urgent and include enough information to locate the material. We will maintain a process for legally sufficient removal requests and act within the time required by applicable law.
11 Copyright
Do not upload content that infringes copyright or other intellectual property rights. A copyright owner or authorized agent may send a notice identifying the protected work, the allegedly infringing material and its location, contact information, a good-faith statement, an accuracy and authority statement under penalty of perjury, and a physical or electronic signature to m.sullivan@pridelab.com and PrideLab LLC, 191 Wetherill Road, Garden City, NY 11530.
We may remove allegedly infringing material and terminate repeat infringers. Formal eligibility for limitations on copyright liability may require PrideLab to register and maintain a designated DMCA agent with the United States Copyright Office; publication of these Terms alone does not complete that registration.
12 PrideLab Rights and Intellectual Property
The Service, software, design, branding, text, graphics, interfaces, databases, and other PrideLab-provided materials are owned by PrideLab or its licensors and protected by law. Subject to these Terms, PrideLab grants you a limited, personal, revocable, nonexclusive, nontransferable license to use the Service for its intended purpose. No other rights are granted.
If you provide feedback or suggestions, you permit us to use them without restriction or compensation, but we are not required to do so.
13 Privacy
Our Privacy Policy explains how we collect, use, disclose, and retain personal information. By using the Service, you acknowledge that policy. Privacy choices and legal rights described in the Privacy Policy remain subject to applicable law.
14 Third Party Services
The Service may depend on or link to third-party courts, clubs, maps, communications providers, authentication providers, email services, hosting services, payment tools, or websites. PrideLab does not control and is not responsible for third-party services, availability, rules, content, charges, security, or privacy practices. Your use of them may be subject to separate terms.
15 Fees and Future Paid Features
Finding Fourth may offer free and paid features. Before charging you, we will disclose the price and material payment terms and request authorization. Except as required by law or expressly stated at purchase, fees paid to PrideLab are nonrefundable. Court, club, instructor, guest, or player-arranged charges are not PrideLab fees unless clearly identified as such.
We may change or discontinue features, introduce fees, or revise pricing prospectively. A new charge will not be imposed on you without the notice and authorization required by law.
16 Suspension Termination and Account Deletion
You may stop using the Service and request account deletion as described in the Privacy Policy. We may suspend, restrict, or terminate access, remove content, or limit features when we reasonably believe you violated these Terms, created risk or liability, harmed users or the Service, failed eligibility requirements, or when suspension is required by law or operational necessity.
Provisions that by their nature should survive termination will survive, including ownership, licenses already needed for retained records, risk allocation, disclaimers, limitations of liability, indemnification, dispute provisions, and accrued obligations.
17 Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." PRIDELAB DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, SAFETY, AVAILABILITY, AND RESULTS.
PRIDELAB DOES NOT WARRANT THAT USERS ARE WHO THEY CLAIM TO BE; THAT USERS, MATCHES, DRILLS, FACILITIES, RATINGS, FEES, OR CONTENT ARE SAFE, SUITABLE, ACCURATE, OR AVAILABLE; OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE TERMS MAY NOT APPLY TO YOU.
18 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIDELAB AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOST PROFITS, DATA, GOODWILL, OR OPPORTUNITY; OR PERSONAL INJURY, PROPERTY DAMAGE, OR DISPUTES ARISING FROM USER CONDUCT, A MATCH, A DRILL, A FACILITY, TRAVEL, OR AN OFFLINE INTERACTION, EVEN IF ADVISED OF THE POSSIBILITY.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF PRIDELAB FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID DIRECTLY TO PRIDELAB FOR THE SERVICE DURING THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not exclude liability that cannot lawfully be excluded or limited.
19 Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless PrideLab and its owners, affiliates, officers, employees, contractors, and agents from third-party claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from your User Content, your violation of these Terms or law, your misuse of the Service, or your match, drill, payment, facility, or offline arrangement. PrideLab may control the defense and settlement of a covered claim, and you agree to cooperate. This section does not require indemnification for PrideLab's own conduct where prohibited by law.
20 Governing Law and Disputes
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles, except to the extent federal law applies. Before filing a claim, you and PrideLab agree to attempt in good faith to resolve the dispute informally by sending a written description of the dispute and requested resolution and allowing 30 days for a response.
Unless applicable law requires otherwise, any lawsuit arising from or relating to the Service or these Terms must be brought exclusively in the state or federal courts located in Nassau County, New York, and each party consents to personal jurisdiction and venue there.
21 Changes to the Service or Terms
We may modify the Service and these Terms. We will post revised Terms and update the effective date. If a change is material, we will provide additional notice or obtain consent when required. Changes apply prospectively from their effective date. Continuing to use the Service after revised Terms become effective constitutes acceptance where permitted by law; otherwise, you must stop using the Service.
22 General Terms
These Terms and the Privacy Policy constitute the agreement between you and PrideLab concerning the Service, except for additional terms presented for a specific feature. If a provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. PrideLab's failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. PrideLab may assign them in connection with a reorganization, financing, merger, acquisition, sale, or transfer of the Service. Section headings are for convenience only.
